This Vietnam Supplement is a privacy notice. It does not by itself constitute consent, unless you separately provide consent in conjunction with this notice. Where Vietnamese law requires consent, Visa will obtain consent separately in a legally valid form. Where Vietnamese law gives you the right to withdraw consent, you may do so in accordance with Vietnamese law and Visa’s applicable procedures. Withdrawal does not affect processing carried out before the withdrawal request.

For purposes of Vietnamese law, personal data may include basic personal data and sensitive personal data as set out below. Specific personal data that we process will depend on our relationship and interactions with you, as described in the Global Privacy Notice.

Where Visa uses personal data for marketing communications, personalized offers, interest-based advertising, behavioral advertising, targeted advertising, or personalized advertising, Visa will do so in accordance with Vietnamese law.
Where Vietnamese law requires consent for advertising, Visa will provide necessary information about the advertising content, method, form, and frequency and will provide a method to refuse or stop receiving advertising where required by Vietnamese law.
Where Visa uses cookies or similar technologies to collect or share personal data, or to track use of websites, applications, or online services, Visa will provide the notices, choices, and opt-out mechanisms required by Vietnamese law.

Where Visa uses automated processing, including artificial intelligence tools, to process personal data subject to Vietnamese law, Visa will notify data subjects of the processing, explain the operating principles of the relevant algorithm and its effects on their lawful rights and interests, and provide an option not to participate. Where Visa uses personal data subject to Vietnamese law in a big data analytics system, Visa will notify data subjects and explain how their personal data is used in that system.

Where Visa processes personal location data or biometric data, Visa will provide the notices, options, and safeguards required by Vietnamese law.
Where Visa records or films individuals in public places or public activities, Visa will provide notice where required by Vietnamese law, process the resulting personal data only for the relevant lawful purpose, and retain it only for the period necessary for that purpose unless Vietnamese law provides otherwise.
Visa will not listen to, record, or read calls or text messages without consent unless Vietnamese law permits otherwise.

Visa may disclose personal data to the categories of recipients described in the Visa Global Privacy Notice. Where Vietnamese law applies, Visa will transfer or disclose personal data to third parties only with consent or another legal basis permitted by Vietnamese law.
Where Visa transfers sensitive personal data, Visa will apply the additional safeguards required by Vietnamese law.

Where Vietnamese law applies, Visa will delete, destroy, or de-identify personal data when the processing purpose has been completed, the retention period has expired, deletion is required by law or by a competent authority, the data subject validly requests deletion, or another legal basis for deletion applies. To avoid doubt, Visa may refuse or delay deletion where retention is required or permitted by Vietnamese law.

Where Vietnamese law applies, your rights and obligations as a data subject are as provided under Vietnamese personal data protection laws.
Depending on the circumstances, your rights may include:
- to know about personal data processing activities;
- to consent or not consent to the processing of your personal data;
- to withdraw consent to the processing of your personal data;
- to view, correct, or request correction of your personal data;
- to request provision, deletion, or restriction of processing of your personal data;
- to object to the processing of your personal data;
- to complain, denounce, initiate lawsuits, and claim damages in accordance with Vietnamese law;
- to request competent authorities or relevant parties involved in personal data processing to take measures to protect your personal data.
Your obligations may include:
- to protect your own personal data;
- to respect and protect others’ personal data;
- to provide complete and accurate personal data where required by Vietnamese law, contract, or when giving consent;
- to comply with Vietnamese personal data protection laws and participate in preventing and combating personal data infringement;
- to exercise your rights and obligations in accordance with Vietnamese law and your contractual obligations, and for the purpose of protecting your own lawful rights and interests;
- not to obstruct Visa or other relevant parties in exercising their legal rights or performing their legal obligations;
- not to infringe the lawful rights and interests of the State, agencies, organizations, or other individuals.

In the course of your interactions or relationship with Visa, you may provide Visa with personal data of third parties. You must comply with applicable Vietnamese personal data protection laws and are responsible for ensuring that such personal data is collected and disclosed to Visa lawfully. For any third-party personal data you provide to Visa, you represent that you have obtained all consents or other valid authorizations required for its collection and disclosure to Visa for the purposes contemplated under your agreement(s) with Visa, as applicable, and described in the Visa Global Privacy Notice or this Vietnam Supplement.

If you believe Visa has processed your personal data in violation of applicable law, you may contact the Visa Global Privacy Office or the Vietnam contact point identified by Visa. You may submit complaints, denunciations, lawsuits, or damages claims in accordance with Vietnamese law.
